1 Offer and Contract
The published prices are binding (subject to alternation by "Sauber Racing Art" only). All prices are inclusive 7.6% VAT (Switzerland).
Requested deliveries, products or performances that are not part of the offer on the Internet, will be charged additionally.
An offer or order is valid until its cancellation, or unless something else has been agreed upon in written form. The contract materializes out of the confirmation of the order, which can be done exclusively over the official Sauber Racing Art web page. All orders are binding.

2 Internet auction
The hs-partner GmbH offers with www.sauberracingart.com a platform for Internet auctions on which - among other things - converted original Formula 1 pieces from the Sauber Petronas racing team are sold. The auction of each product starts with a minimum offer and the price will be determined by offer and demand. The auctions on www.sauberracingart.com are not conventional auctions in the sense of the regulations of the obligation law. The bidding time is limited and the lot goes to the highest bid at the set time.

2.1 Auction Rules
The INM AG may request a minimum price for a product. If the minimum price is not reached then no valid sales contract has come out of the auction. Neither the supplier nor the buyer has to hand over respectively to accept the product. The data of offers that were not the successful will be collected. If a successful highest bid has to withdrawn, the second highest bid will succeed. The finish times are approximately. The times stated refer to the time on www.sauberracingart.com. The hs-partner GmbH does not accept responsibility for the correspondence with any other official time. An auction generally goes on until the stated deadline. hs-partner GmbH is allowed to shorten or lengthen this period but only after announcing this expressively on www.sauberracingart.com and/or via email to the bidders.

2.2 Cession
INM AG GmbH is fully entitled to transfer the rights for the auction on www.sauberracingart.com to a third party - full or partial - as long as the submitted conditions are being followed.

3 Conditions of payment
The goods can be paid for exclusively with credit card. Number and expiry date have to be stated with the order.

4 Security and Privacy
All data supplied will be encoded with the tried and tested SSL-technology. The data of the credit card will be encoded as well. Each transaction will be tested and authorized online by the relevant credit card company. Frozen or faked cards cannot be used. Personal information will be treated confidential in accordance with all relevant Swiss data protection legislation. We will not sell, share, trade or license any of your personal information to others. We reserve the right to disclose your information if requested by any government authority.

5 Delivery and Dates
The goods will be delivered without charge to any mail address within Switzerland. The client will partly pay for deliveries outside of Switzerland. The client pays additionally for taxes and duties outside of Switzerland. The client is bound to buy and pay for the goods. In Switzerland, the delivery will take place within 1 to 2 weeks after the order. The client will be informed about any delays as soon as possible.

6 Complaint
Complaints because of faulty or damaged goods can be made within 10 days. For justified complaints there will be either a replacement or reparation of the good. Otherwise the price will be reduced or the client returns the good and gets the money back.

7 Liability
"Sauber Racing Art" is only liable for any damages or losses that have been caused deliberately or negligently by "Sauber Racing Art". The client accepts all liability and responsibility for any losses or damages of any kind incurred as a result of faulty or illegal usage.

8 Jurisdiction
Court of jurisdiction in Zurich, Switzerland.
These terms and conditions are subject to Swiss law and the exclusive jurisdiction of Swiss courts, even when goods are order from or delivered to another country. The parties will try to settle all arguments created by this contract amicable. This regulation is also valid for all actions, inclusive all contractual and extra contractual legal relations, that are a result of the auctions.

9 Final Clause
The client accepts these terms and conditions with the order of a product or with the registration for the auction. The terms and conditions are binding and enforceable for an indefinite period of time. Changes and amendments can only be made in written form by "Sauber Racing Art".
